Hometown Grid, LLC provides its service to you, subject to the following Terms of Service ("ToS"), which may be updated by us from time to time without notice to you. By using our services, you agree to be bound by this ToS.
Hometown Grid provides a hosted outage management and customer communication platform for electric, water, gas, and other utilities. Depending on the features a utility enables, the service may include two-way text and voice outage reporting, voicemail transcription, automated interpretation and classification of customer reports, public and internal outage maps, AMI and meter data integration, GIS and connectivity modeling, service orders, damage assessment, vehicle and crew location tracking, notifications to utility personnel, mass notification, and reporting. The service is provided to utilities. Members of the public interact with the service when reporting an outage or receiving communications from their utility.
You agree to use the Hometown Grid service for lawful purposes only and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the service.
As between Hometown Grid and the utility, the utility retains all right, title, and interest in its data. This includes information the utility provides to the service and information generated through its use of the service: customer records, outage reports, customer messages and voicemails, meter and AMI data, GIS and mapping data, service orders, and reports. Hometown Grid claims no ownership of that data. We process it solely to provide the service to the utility and at the utility's direction. We do not sell utility data, and we do not provide it to other utilities or to any third party for that party's own purposes. A utility may request an export of its data at any time, including upon termination.
Parts of the service use artificial intelligence to interpret customer text messages and voicemails, classify and categorize outage reports, and generate summaries. These requests are sent to third-party model providers, currently OpenAI, Anthropic, and Google, which act as processors on Hometown Grid's behalf. Under those providers' business and API terms, the submitting party retains ownership of the information submitted and owns the resulting output; the providers claim no ownership of it. Data submitted through these API platforms is not used to train or improve the providers' models by default, and is retained by them only for a limited period for abuse monitoring before deletion. Hometown Grid does not use one utility's data to train models or build features for another. The providers listed above are current as of the last revision of these Terms and may change. Ownership and non-training terms at least equivalent to those described here are a condition of any provider Hometown Grid uses, and a current list is available on request.
Your privacy is important to us. Hometown Grid does not sell personal information and does not share it with third parties for their own purposes. We do rely on service providers who process data on our behalf and under contract solely to deliver the service, including cloud hosting, messaging and telephony, address geocoding, and the artificial intelligence providers described above. All data transmitted through our service is encrypted in transit, and data at rest is encrypted in our databases and file storage. For more details, please refer to our Privacy Policy.
Hometown Grid reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Hometown Grid makes no warranties regarding the reliability, accuracy, or availability of the service.
To the maximum extent permitted by applicable law, Hometown Grid shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use of or inability to use the service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the service; or (d) any bugs, viruses, or other harmful code that may be transmitted to or through the service by any third party.
Your use of Hometown Grid is subject to these ToS and all applicable laws and regulations.
For customers under a service agreement, termination is governed by that agreement. Hometown Grid does not require long-term contracts. Either party may end the service with reasonable written notice.
Any claim relating to Hometown Grid's service shall be governed by the laws of the State in which Hometown Grid, LLC is registered without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these ToS at any time. Where a utility has a signed service agreement with Hometown Grid, that agreement controls in the event of any conflict with these Terms, and no change to these Terms reduces the rights granted to that utility under its agreement.
